Details released of Benson's Lake Travis arrest
05:31 PM CDT on Monday, May 5, 2008
There were more details Monday about the arrest of a former UT football player on Lake Travis over the weekend.
Lower Colorado River Authority police stopped Cedric Benson, 25, Saturday night for a random safety inspection. Benson was operating a 2007 30-foot Cobalt motor boat with 12 to 15 people on board in Devil's Cove.
According to the affidavit, the arresting officer said Benson had a strong odor of alcohol on his breath, his eyes were bloodshot and his attitude was combative. The officer also said at times Benson was cooperative and polite but at other times he was insulting, cocky and even used profanity. The officer also said his speech was slurred.
The officer said that Benson was given water-based sobriety tests and did not pass the tests.
Benson was told to put on a life jacket because he was going to get in the officer's patrol boat and be carried ashore to do land-based tests. The officer said Benson refused. At that time the officer asked Benson to kneel down, he was going to place handcuffs on him because he was under arrest. The officer said he, in a very hostile way, refused and said he passed all tests.
"I touched his body in an attempt to direct him and he presented himself in a very hostile way. Benson is a very muscular person and easily capable of overpowering me. As I had exhausted all attempts to gain control of Benson, and been met with resistance and what I perceived as a threat, I administered pepper spray into Benson's face to gain control. Only after this was I able to restrain Benson," LCRA Sgt. Leonard Snyder said.
Benson was taken to the Emerald Point Marina where an officer was waiting to take him to central booking. Once at the marina, the officer said Benson refused to get out of the patrol boat and had to be "physically removed." Officers had to carry him to the vehicle.
Benson was taken to the Travis County Jail. Officers say he refused a breathalyzer test.
LCRA police say no other football players were identified as passengers on the boat. No one else was arrested.
Benson was release on $14,500 bond.
