No change in pot policy at APD -- for now

Last session, state lawmakers relaxed the rules for people caught with four ounces of pot or less, but the Austin Police Department is sticking to its old protocol, at least for now.

"They're still booked into jail," said APD Commander Jeffry Adickes.

The law now gives agencies an option to let off minor pot carriers with a ticket and a court date, instead of arresting and booking them. The offense is still a Class B misdemeanor -- punishable with up to a $1000 fine or six months in jail.

Travis County Sheriff's Office has already changed its policy in light of the new law.

"It removes that booking process; it keeps that deputy in the district; it keeps them available to answer calls," said Sheriff's Office spokesman Roger Wade.

APD says it's in the process of "reviewing" its current policy, but because its jurisdiction overlaps with Hays, Williamson and Travis counties, things are trickier.

Hays and Williamson Counties are continuing to arrest people for any amount of pot.

"So as we look at the policies, we need to look at all three jurisdictions when we make a policy change going forward," said Adickes.

Deputies in Travis County say they are saving a lot of time by not booking people for minor offenses.

APD says it is "open" to the change in policy, but for now, getting caught with a little grass will mean different things, depending on which agency the officer works for.
